Utilizing the new powers from the Digital Markets, Competition, and Consumers Act (DMCCA), the Competition and Markets Authority (CMA) has concluded its investigations into Google’s Play Store and Apple’s App Store.

The investigations initially targeted concerns that both tech giants were unfairly exploiting their dominant market positions, adversely affecting UK app developers and consumers. The primary focus was on their policies requiring the use of proprietary in-app payment systems. The CMA highlighted that such policies could suppress competition, diminish consumer choice, and potentially inflate prices.

Google’s efforts to placate the regulatory body with proposed solutions labeled ‘Developer-only Billing’ (DOB) and ‘User Choice Billing’ (UCB) were found lacking. Despite being aimed at providing developers with alternative payment methods, these proposals didn’t satisfy the demands following consultations with industry stakeholders.

App developers, expressing their concerns to the CMA, claimed that Google’s adjustments were insufficient, maintaining their dependence on Google’s costly commission fees and interruptive ‘pop-up screens’ during payment processes.

The conclusion of these investigations by the CMA coincides with the recent introduction of the DMCCA. This legislation strengthens the CMA with greater authority to tackle anti-competitive practices in the digital market. Importantly, it sets the stage for potentially classifying major companies like Google and Apple as possessing ‘strategic market status’ within areas such as mobile ecosystems.

“With the forthcoming enforcement of the new pro-competition digital markets framework, we will be equipped to apply these enhanced powers to concerns that have surfaced in our prior investigations,” stated Will Hayter, the Executive Director for Digital Markets at the CMA.

This development indicates that the CMA is ready to utilize its new capacities if entities like Google or Apple are recognized with ‘strategic market status’. Such status would enable the CMA to more comprehensively tackle competitive challenges, possibly leading to broader regulatory actions.

“It’s critical that tech businesses in the UK, including app developers, can have access to a fair and competitive app ecosystem, helping to grow the sector, boost investment, and result in better outcomes for UK consumers,” added Hayter. “These are all factors we are considering before launching our first investigations under the new regime.”

The CMA’s decision signals a new chapter in the ongoing tussle to ensure fairness and competition within the app economy. With its sights set on the DMCCA’s potent toolkit, the watchdog aims to tackle any perceived market imbalances head-on.
