Noon, a prominent e-commerce platform in the UAE, recently lost a cybersquatting dispute regarding the domain noon.ae after allowing it to expire. Initially, Noon had owned this domain but claimed the expiration was accidental.
In January, the domain was auctioned by a brokerage that specializes in expired .ae domains. It was purchased by Omar Tarabichi, who subsequently launched a site called Noon Learning on it. Tarabichi is also the owner of other generic .ae domains.
The term "noon" is significant, not only as an English word but also as the 25th letter of the Arabic alphabet, which Noon incorporated into its logo ( نَ ).
According to the cybersquatting regulations for .ae domains, a dispute can be upheld if a domain is found to be registered or used in bad faith. However, a three-member panel from the World Intellectual Property Organization concluded that Noon could not substantiate claims of bad faith, leading to the dismissal of the dispute and the retention of the domain by Tarabichi. Hadef & Partners represented Noon, while John Berryhill represented Tarabichi.
