Imperial Valley Computer Manufacturing (IVCM) has filed a lawsuit against the Imperial Irrigation District (IID) after its request for around 260 million gallons of Colorado River water each year was denied. The water is intended for cooling a proposed 330 MW AI data center in Imperial County. This legal battle serves as a pivotal example addressing the potential redirection of agricultural water for industrial uses, which is central to the county’s ambitious Lithium Valley development strategy.
The lawsuit centers on IVCM’s argument that it has leased 160 acres of farmland, which consumed roughly the same amount of water now earmarked for the AI campus. The company plans to retire this farmland from agricultural production, asserting that the water conserved should instead be allocated to their new project.
IID rebuffed the request on May 1, 2026, igniting a dispute that could have significant implications regarding the laws governing water transfers from agriculture to industry. As Imperial County pushes forward with its Lithium Valley Specific Plan, a recent Water Supply Assessment (WSA) suggests that the area can sustain new developments—spanning lithium processing, manufacturing, logistics, and data centers—by reallocating Colorado River water from retired farmland.
Currently, approximately 149,000 acre-feet of Colorado River water is supplied annually to agriculture in the Lithium Valley area. Projections indicate that industrial growth would require significantly less water over future decades. By shifting agricultural water allocations and emphasizing water recycling initiatives, the goal is to fulfill industrial demands without exceeding the existing agricultural use levels.
However, the WSA confirms that IID’s existing policies do not support the necessary water reallocation. Currently, IID provides only 18,620 acre-feet of water each year for new non-agricultural users, while growth projections indicate a need for over three times that amount in the near future.
Neil Osnato, founder of Persistence Analytics Group, notes that the lawsuit epitomizes a larger issue as utilities assess significant AI campus projects requiring multiple essential resources. He argues that considering each resource in isolation could lead to a variety of operational dilemmas for utilities and potentially prompt legal actions.
To bolster future developments, Imperial County’s strategy includes constructing a regional water distribution system and establishing new infrastructure management entities.
The IVCM campus is projected to consume around 880 acre-feet of water annually, constituting a minor fraction of the total projected industrial demand for the planning area. However, the outcome of this lawsuit could fundamentally determine whether agricultural water can be redirected to facilitate the industrial expansion envisioned for Lithium Valley. Should IID maintain its stance against such transfers—regardless of policy revisions—it may significantly hinder the development of future lithium processing, manufacturing plants, and AI data centers within the region.
