A judge has dismissed a lawsuit involving GoDaddy and the clawback of expired domains, citing a lack of subject matter jurisdiction. The case was brought by Crisby Studio AB, a Swedish company that had purchased the domain calor.com in an auction on GoDaddy in April. However, about two months later, GoDaddy returned the domain to its previous owner, leading Crisby to file a lawsuit against the company in August.
In a later development, another plaintiff, Prime Loyalty, joined the case after acquiring butane.com for $19,755 in a similar GoDaddy auction and experiencing a similar clawback of the domain. GoDaddy contended that the lawsuit had significant deficiencies, primarily failing to provide the citizenship information of the constituent members of the Plaintiff LLCs and that the addition of Prime did not resolve the initial lack of diversity jurisdiction necessary for the case to proceed.
The court sided with GoDaddy and dismissed the lawsuit without prejudice, meaning that the plaintiffs have the option to refile the case in the future.
