A French skincare brand, Cosmetic Research Group, has faced backlash after being found to have engaged in reverse domain name hijacking regarding the domain soskin.com. The dispute arose when the company contested the domain registered by Robert Soskin since 1998, whose surname matches the domain.

Despite the obvious surname connection, the company forged ahead with its case, attempting to sway the panel by referencing unrelated past disputes. They claimed that Soskin could have opted for a different domain like soskinfamily.com rather than using his last name. However, this argument failed to convince the panelist.

Throughout the proceedings, there was only one minor issue noted against Soskin: his registrar had placed pay-per-click ads on the site, some of which linked to cosmetic products. Panelist Andrew Lothian emphasized that this did not alter the fundamental reasoning of the case.

In a detailed analysis, Lothian highlighted that the complainant was fully aware of the surname association of the domain and that Soskin had been the longstanding registrant. He criticized the complainant for not doing proper research regarding the domain’s use history, which showed it had primarily been a family website in addition to its email utility. The panelist pointed out that the complainant’s failure to recognize the distinct circumstances surrounding this case from others they cited indicated an apparent misunderstanding of reverse hijacking laws.

Ultimately, the complaint was rejected, with Lothian noting that the case should not have progressed once Soskin’s identity was revealed. He expressed concern that the complainant missed an opportunity for an amicable resolution prior to the dispute escalating to formal proceedings.
