
A U.S.-based company, Park Avenue Capital LLC, has launched an international arbitration claim against the Republic of Moldova concerning the rights to the .md country code top-level domain. The claim was filed with the International Centre for Settlement of Investment Disputes (ICSID), an entity that resolves conflicts between foreign investors and sovereign states as per international investment treaties.
The source of contention is linked to an agreement in which Park Avenue was authorized to provide second-level .md domain names across North America, Latin America, Australia, and other English and Spanish-speaking territories. The company, which operates under the name MaxMD, specializes in healthcare technology.
The initial 20-year contract expired in 2022, and Park Avenue is contesting the government’s decision not to renew it. They argue that the contract allowed for two consecutive 20-year terms. In addition, they allege that Moldova’s regulatory actions have harmed their contractual rights. After attempting to resolve the matter through arbitration according to their contract, Moldova responded by seeking proposals for legal representation.
Park Avenue has since turned to ICSID for resolution, and their legal representation includes Nater Dallafior, Three Crowns, and Anastasiya Ugale.
