Trump’s New Initiative: Targeting Foreign Grid Equipment Amid Rapid Data Center Expansion

President Donald Trump has proclaimed a national emergency concerning the U.S. bulk power system. This directive mandates the Department of Energy (DOE) to restrict specific foreign-produced grid equipment and attach conditions to equipment currently in use. For data center operators who are hurrying to secure power for their AI infrastructures, this order introduces yet another obstacle in the procurement of essential equipment needed to connect projects to the electrical grid. Items such as transformers, inverters, and controls are already experiencing prolonged lead times and sourcing difficulties. The new federal restrictions could exacerbate these issues, impacting procurement processes, project costs, and scheduling for new power capacity.

The order, issued on August 26, generally forbids the acquisition or installation of certain foreign-manufactured bulk-power system equipment and associated critical software if they pose specified national security risks. The focus is on risks like sabotage, unauthorized access, and disruption of vital infrastructure, notably excluding facilities used for local electric distribution.

According to the White House, the surge in advanced manufacturing, artificial intelligence, and defense production has heightened U.S. dependence on select foreign components essential for maintaining a stable and reliable electricity supply. Ongoing reliance on foreign sources for bulk power equipment is seen as a potential vulnerability in the supply chain.

The executive order also extends to equipment in operation, giving the DOE the authority to impose stipulations on their continued use based on reliability considerations. These can include equipment origins, vendor control, and related software dependencies, which may now become criteria in determining reliability.

Neil Osnato, founder of Persistence Analytics Group, notes that this order may shift focus from mere functionality to also include the origins and accessibility of the equipment, alongside who can access it.

The Energy Secretary is tasked with identifying bulk-power system equipment that may pose risks and to prepare recommendations for mitigating these hazards. The scope of this initiative extends beyond physical components, encompassing associated software, firmware, and digital capabilities that could introduce cybersecurity risks.

In essence, the administration is addressing foreign supply chain dependency as a continuity-of-service and national security concern rather than a straightforward trade issue, which complicates the procurement strategy since assessing risk may not be as simple as knowing where a piece of equipment was manufactured.

Furthermore, the North American Electric Reliability Corporation (NERC) emphasizes the significance of supply chain security as a continuously evolving concern affecting grid reliability. NERC is collaborating with the DOE and other agencies as the executive order is put into effect.

As data center developers grapple with project timelines constrained by power availability, the equipment subject to this order already struggles with protracted lead times linked to AI and data center expansion. This situation poses challenges for timely equipment procurement, vital for project completion.

The DOE has 120 days to establish the rules for implementing the order and determine how it will affect specific equipment, suppliers, and projects. This uncertainty leaves utility and data center developers questioning how much additional scrutiny will be required prior to ordering and deploying critical equipment into service.
