This legal action highlights an earlier attempt by the Italian organization to trademark "Prosecco" in the U.S., which was denied by the U.S. Patent and Trademark Office due to the term not serving as a certification mark for regional origin.
Best Drinks argues that the UK lawsuit is a case of forum shopping, as the UK generally has a more favorable perspective on geographic indications. They also pointed out that the primary defendant in the UK lawsuit is the former owner of the domains, who currently resides in the UK.
With a court response to the UK lawsuit expected by October 22, Best Drinks is requesting a temporary restraining order to block the transfer of the domains to the Italian organization. Attorney Jeffrey Neuman is representing Best Drinks in this ongoing dispute.
