Oniric Studio SRL, a video game company founded in 2020, has recently been found attempting reverse domain name hijacking of oniric.com. The company, which registered a trademark for "oniric" in 2021, filed a complaint against the domain owner, Stanley Pace, who had originally registered the domain in 2012.
Czech Arbitration Court panelist Fabrizio Bedarida ruled against Oniric Studio, stating that the case was filed in bad faith. He pointed out that there was no evidence suggesting that Pace had registered the domain with the intent to harm the Oniric brand or to prevent the company from obtaining the domain. The ruling emphasized that the registration occurred eight years before Oniric Studio’s existence, making it impossible for Pace to have targeted a company that did not yet exist.
The complaint was represented by Mr. Pierre-Yves Thoumsin, while John Berryhill defended Pace’s ownership of the domain. The ruling highlights the importance of establishing a legitimate claim in cases of domain disputes, particularly when the complainant is attempting to claim a domain registered well before their own trademark rights were established.
