A real estate broker from Virginia has faced criticism after attempting to reverse-hijack the domain name UpscaleAvenues.com. This action led to a ruling by a panelist at the World Intellectual Property Organization (WIPO) against Victor Adam Bosak III, who filed a dispute against Robert Rogers, a former business partner.
Rogers registered the domain in 2018, coinciding with the formation of his company, Upscale Ventures, LLC. The two had signed a trademark co-ownership agreement the following year. Bosak initiated the case pro se, meaning without legal representation, and his submissions were flagged for containing numerous fabricated case citations. While some referenced cases were real, they did not support Bosak’s claims.
Panelist Robert A. Badgley expressed serious concerns over Bosak’s filings, pointing out the abundance of outright false citations. He noted that while an occasional error might be overlooked, the volume of inaccuracies warranted a stricter response. Badgley drew parallels to other recent incidents in the legal sector involving lawyers misusing artificial intelligence to produce misleading citations, suggesting Bosak might have similarly relied on faulty information.
In addition to the baseless claims, Bosak made five unsolicited supplemental filings before Rogers had a chance to respond, which the panelist deemed "improper and borders on abusive." Badgley admonished Bosak for pursuing a weak case, particularly given their shared history and the existing trademark agreement.
