Mira Holdings contended that they were not exclusively targeting Temco Industrial since many companies share the name "Temco." In discussions with a GoDaddy broker, they expressed a willingness to wait for any interested company to purchase the domain, citing the Complainant as just one of several potential buyers.
The panel distinguished between targeting a specific trademark holder and the general targeting of trademark holders. In their assessment, since Temco Industrial was among the companies Mira believed might be interested in the domain, the panel found this targeted approach significant enough to conclude that Mira was acting in bad faith.
The ruling referenced a prior case involving Mira and the domain bowtex.com, where a similar decision led to the domain’s transfer. Although some could argue that "temco" is a more generic term than "bowtex," the panel noted important nuances that were present in this specific case compared to others involving dictionary terms.
Ultimately, the panel determined that Mira Holdings not only targeted Temco Industrial but also indicated registration of the domain was made in bad faith. This decision raises questions regarding the ownership of domains, especially in cases with multiple companies using similar names.
