A U.S. District judge has allowed a cybersquatting lawsuit regarding the domain name outside.com to proceed. The case was brought by Outside Interactive, a company specializing in sports and outdoor media, which is seeking to acquire the domain from its current owner, Joshua Bolin. This is not the first legal attempt by Outside Interactive; their predecessor had previously filed a complaint with the World Intellectual Property Organization in 2006, which was dismissed.
Bolin acquired the domain after the earlier complaint was denied. Outside Interactive’s legal action accuses Bolin and his bank, Westlake Securities, of cybersquatting and other related claims. The company alleges that they attempted to engage in negotiations for the sale of the domain and even set up a website that would infringe on its trademarks.
In response, Bolin and Westlake Securities filed motions to dismiss the case. Bolin contended that the court lacked personal jurisdiction over him, while Westlake argued that Outside Interactive’s claims against them were unfounded since they did not intentionally cause Bolin to infringe on Outside’s trademark.
However, the judge has overruled these motions, allowing the lawsuit to move forward.
